Terms and Conditions of Service

These Terms and Conditions of Service ("Terms") govern your access to and use of the mobile intravenous (IV) hydration and intramuscular (IM) injection services (collectively, "Services") provided by Living Drip Wellness Spa ("LDWS," "We," "Us," or "Our"). By scheduling or receiving Services, you ("Client" or "You") agree to be bound by these Terms.

1. Scope of Service and Eligibility

1.1. Nature of Services: LDWS provides non-emergency, elective wellness Services through mobile concierge appointments within our service area, primarily covering Placer, Sierra, Yuba, and Nevada counties in Northern California. 1.2. Medical Oversight: All Services are administered by Licensed Registered Nurses (RNs) under the standing orders and protocols of a supervising California Licensed Medical Director. 1.3. Eligibility: You must be eighteen (18) years of age or older to receive Services. You represent and warrant that you are not experiencing a medical emergency and are seeking Services for general wellness purposes only.

2. Medical Disclaimer and Client Responsibilities

2.1. Medical Disclaimer: LDWS Services are not a substitute for medical diagnosis, treatment, or care provided by a primary care physician or emergency services. If You are experiencing a medical emergency, You must call 911 immediately. 2.2. Clinical Assessment: The RN administering the Service will perform a brief clinical assessment prior to treatment. LDWS reserves the right, at its sole discretion, to refuse service to any Client if the RN or Medical Director determines, for any reason, that the service is medically contraindicated, unsafe, or if the Client's health condition warrants a physician consultation. In such cases, a reduced consultation fee may apply. 2.3. Client Honesty: You agree to provide accurate, complete, and truthful medical history and current health information to the administering RN. You acknowledge that failure to disclose relevant information may result in adverse outcomes.

3. Scheduling, Fees, and Payment

3.1. Pricing: Pricing for Services is available on our website and is subject to change without prior notice. The agreed-upon price is confirmed at the time of booking. 3.2. Payment: Full payment is due at the time the Service is rendered. We accept all major credit cards. We do not accept insurance; all Services are considered "out-of-pocket" expenses. 3.3. Travel Fees: Appointments outside our standard service radius may incur an additional travel fee, which will be communicated and agreed upon prior to booking. 3.4. Failed Venipuncture/Cancellation on Arrival: If the RN is unable to successfully initiate the IV after three attempts, or if the RN cancels the service on arrival due to a contraindication (see Section 2.2), a $30 administrative and assessment fee will be charged. The remainder of the payment will be refunded.

4. Cancellation and Rescheduling Policy

4.1. Client Cancellation: Cancellations made by the Client less than 24 hours before the scheduled appointment time will be subject to a $99 cancellation fee. 4.2. LDWS Cancellation: LDWS reserves the right to cancel or reschedule appointments due to inclement weather, staffing emergencies, or circumstances beyond our control. In such events, the Client will be notified immediately, and a full refund will be processed, or the appointment will be rescheduled at no extra cost.

5. Client Venue Responsibilities

5.1. Suitable Environment: The Client must provide a clean, safe, private, and temperate environment for the RN to administer the Service. This includes a comfortable chair or couch for the duration of the infusion (typically 45–60 minutes) and adequate lighting. 5.2. RN Safety: The Client must ensure that the environment is safe for the administering RN, free from aggressive individuals or animals. LDWS reserves the right to terminate service immediately without refund if the RN feels unsafe or threatened.

6. Privacy and Confidentiality

LDWS strictly adheres to all federal and state privacy regulations, including the Health Insurance Portability and Accountability Act (HIPAA). Your health information will be protected as described in our separate Privacy Policy (available on our website).

7. Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  • If we provide desktop, mobile or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

You must not:

  • Modify copies of any materials from this site.

  • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.

  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site.

You must not access or use for any commercial purposes any part of the Website or any services or materials available through the Website. 

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Website in breach of the Terms of Use, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the Website not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws.

8. Trademarks

The Company name, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

9. Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries). 

  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.

  • To send, knowingly receive, upload, download, use, or re-use any material which does not comply with the Content Standards set out in these Terms of Use.

  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail”, “chain letter”, “spam”, or any other similar solicitation.

  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).

  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website or expose them to liability.

10. Indemnification and Governing Law

10.1. Indemnification: You agree to indemnify and hold harmless LDWS, its RNs, and its Medical Director from and against any claims, damages, liabilities, and expenses arising from or relating to Your breach of these Terms, Your non-disclosure of medical history, or Your misuse of the Services. 10.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the courts located in Placer County, California.

BY PROCEEDING WITH BOOKING OR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS AND CONDITIONS OF SERVICE.
